Terms for the sale of a philatelic subscription of postage stamps, postcards and postal stationery, first day covers (FDCs), imprints of commemorative cancellations and miniature sheets of postage stamps via the Online Store of Poczta Polska S.A.



I. General provisions


§ 1

1. This document, hereinafter referred to as the “Terms”, defines the terms for ordering a philatelic subscription of postage stamps, postcards and postal stationery, first day covers (FDCs), imprints of commemorative cancellations and miniature sheets of postage stamps and for the sale of the subscribed philatelic items via the Online Store of Poczta Polska S.A. operating at: www.sklep.poczta-polska.pl. 
2. For matters related to orders for the philatelic subscription, the seller should be contacted at sklep@poczta-polska.pl.

§ 2

The terms used herein have the following meaning:

  1. philatelic subscription (subscription) – a set of philatelic items classified into a specific subscription group indicated in § 3(1), delivered quarterly;
  2. subscriber – a natural person, legal person or unincorporated entity placing an order for the philatelic subscription;
  3. miniature sheet of postage stamps – form of issue of cancelled or non-cancelled postage stamps containing 5 to 16 copies of regular-issue stamps, regardless of their arrangement;
  4. commemorative cancellation – a decorative commemorative cancellation with a short text and a graphic element, used to cancel postage stamps and prepare FDCs issued on the first day of sale;
  5. business days – calendar days, excluding statutory holidays (according to the applicable codes);
  6. circulation issues – postage stamps issued by the seller in multi-million unlimited issues;
  7. subscription unit – philatelic items issued by the seller during the calendar year in a specific subscription group indicated in § 3(1), excluding special issues;
  8. FDC – an envelope with an image thematically related to the affixed stamp issued by the seller with an inscription reading: “Pierwszy Dzień Obiegu FDC” (First Day Cover), affixed with a postage stamp cancelled with a commemorative FDC cancellation;
  9. subscription fee – a fixed fee collected for the maintenance of documentation and distribution of subscription units; 
  10. issue plan – a list of postage stamp subjects, arranged according to the order in which they should be placed on the market and the number of times each subject is presented, determined by the minister in charge of communication and published at https://poczta-polska.pl;
  11. subscription specification – a list of postage stamps, postcards and postal stationery, first day covers (FDCs) and miniature sheets of postage stamps of a specific subscription group indicated in § 3(1) placed on the market in the given quarter of the particular calendar year, published online at https://poczta-polska.pl;
  12. philatelic items – postage stamps, postcards or postal stationery, first day covers (FDCs), imprints of commemorative cancellations and miniature sheets of postage stamps issued by the seller according to the issue plan for the particular calendar year;
  13. special issue – a form of postage stamps issued in accordance with the annual postage stamp issue plan (e.g. black print, official reprint, philatelic folder, die proof, unperforated edition and other special editions);



II. Philatelic Subscriptions


§ 3

 1. Orders for philatelic subscriptions are accepted in the following subscription groups: 

  1. A – non-cancelled stamps (mints); 
  2. E – cancelled stamps;
  3. C – postcards and postal stationery; 
  4. S – first day covers (FDCs); 
  5. D – imprints of commemorative cancellations;
  6. KA – miniature sheets of non-cancelled postage stamps (mints);
  7. KE – miniature sheets of cancelled postage stamps.
2. The unit of sale in the given subscription group is a single stamp or its basic form of issue, postcard or postal stationery, FDC or imprint of a cancellation on a stamp affixed to a card or a miniature sheet of postage stamps.
3. The philatelic subscription does not include postage stamps and miniature sheets of postage stamps issued as special editions and out-of-print stamps.
4. The philatelic subscription in the KA and KE group includes the following:

  1. a pool of 1000 miniature sheets of postage stamps published in a particular calendar year; 
  2. full issue forms specified by the seller in the subscription specification, without the possibility of ordering a single postage stamp.


§ 4

1. Orders for philatelic subscriptions are taken from 2 January:

  1. in groups A, E, C, S and D via:
          a) the Online Store of Poczta Polska S.A.,

          b) post offices; 

     2. in groups KA and KE – via the Online Store.
2. The ordering terms as indicated in paragraph 1(1)(b) have been regulated in a dedicated internal legislative act available online at https://poczta-polska.pl.
3. Orders for philatelic subscriptions of groups A, E, C, S and D are taken for a half-year period or a one-year period:

  1. one-year orders for a philatelic subscription (including the 1st, 2nd, 3rd and 4th quarter of the particular calendar year) are accepted by 30 June of the particular year;
  2. from 1 July to 31 December of the given year, orders can also be placed for the second half-year (including the 3rd and 4th quarter).
4. Orders for philatelic subscriptions of groups KA and KE are accepted for a one-year period, until the exhaustion of the pool indicated in § 3(4)(1).
5. The subscriber may choose not to collect circulation-issue stamps and FDCs. The subscriber should submit the request before the order is fulfilled.
6. In the order for the philatelic subscription, subscribers have to specify their address and the shipping address and indicate the selected subscription group referred to in § 3(1) as well as the number of subscription units. 
7. After placing the order, the subscriber receives an automatically generated email with information about the order number, ordered subscription groups, number of units and subscription fee with details for the payment. Making the payment is a necessary condition for the order to be accepted for processing. 

§ 5

1. The seller will collect a subscription fee for accepting the order for a philatelic subscription.
2. The subscription fee for philatelic subscription handling is non-refundable, does not include the price of the philatelic items, is not regarded as a down payment and amounts to PLN 4.92 (incl. VAT) per subscription unit, subject to paragraph 3 and the provisions concerning withdrawal from the contract.
3. The subscriber will be exempt from the subscription fee in the following situations:
     1. if the order for the philatelic subscription is placed for at least 10 entire subscription units issued during the calendar year and belonging to the following groups:

          a) A – non-cancelled stamps, or

          b) KA – miniature sheets of non-cancelled postage stamps; and

     2. if the ordered subscription units as indicated in paragraph 1(a) or (b) are collected by the subscriber.
4. After the criteria defined in paragraph 3 are met, every additional order for the philatelic subscription, regardless of the selected subscription group and the number of subscription units, will also be exempt from this fee. 
5. A subscriber who is exempt from the subscription fee will receive:

  1. stamps in sheets or fragments of sheets;
  2. FDCs, postcards and postal stationery in the uncollected form.
6. If the subscriber chooses not to order some of the subscription units indicated in paragraph 3, the applicable subscription fee will be considered in the subscription summary for the following quarter.
7. If the subscriber chooses not to collect a part of the subscription subject to an exemption from the subscription fee, the seller will send designated subscription units.

§ 6

1. If the subscriber has met the requirements for subscription fee exemption set forth in § 5(3)(1), they will receive a 5% discount on the value of the purchased philatelic items of subscription groups A, C, S and D.
2. The discount also applies to any additional subscription orders placed by the subscriber for the full subscription groups listed in paragraph 1.



III. Delivery or collection of the philatelic subscription


§ 7

1. The philatelic subscription will be delivered or collected in four quarterly stages, upon the end of each quarter of the particular year. The delivered items will be the items issued in the given quarter of the particular year.
2. Delivery or collection of the philatelic subscription for the current quarter is possible only after the entire philatelic subscription from the preceding quarter is bought.
3. Within 30 business days of the end of each quarter, the seller will provide the subscriber with information concerning the philatelic subscription for the current quarter.
4. In special cases, not attributable to the seller, the delivery of the philatelic subscription may be delayed. The new date will be publicly announced through the placement of suitable information at post offices and online at: https://sklep.poczta-polska.pl. 

§ 8

1. Fees for the philatelic items delivered to the subscriber will be determined as follows:

  1. for a subscription of non-cancelled postage stamps (group A) – an amount equal to the denomination of the received stamps;
  2. for a subscription of cancelled stamps (group E) – an amount equal to 60% of the denomination of the non-cancelled stamps plus VAT as per the rate applicable on the date the subscription is collected;
  3. for a subscription of first day covers (group S) – the price of those issues plus VAT as per the rate applicable on the date the subscription is collected;
  4. for a subscription of postcards and postal stationery (group C) – the price of those issues;
  5. for a subscription of imprints of commemorative cancellations (group D) – an amount equal to the value of the issues stamped with those cancellations plus VAT as per the rate applicable on the date the subscription is collected;
  6. for a subscription of miniature sheets of non-cancelled postage stamps – an amount equal to the denomination of the postage stamps in the miniature sheet;
  7. for a subscription of miniature sheets of cancelled postage stamps – an amount equal to 60% of the denomination of the stamps in miniature sheets plus VAT as per the rate applicable on the date the subscription is collected. 
2. The nominal value of postage stamps whose denomination is indicated without Arabic numerals (non-denominated stamps) corresponds to the fee for the relevant letter as per the Price list for common domestic and international services applicable as of the date of issue of the stamp.
3. Orders for imprints of commemorative cancellations are fulfilled as follows:

  1. imprints of commemorative cancellations are put on prepaid postcards, postcards with an affixed postage stamp and postal stationery with the denomination corresponding to the minimum payment for a regular unregistered letter in the S format weighing up to 500 g, as per the applicable Price list for common domestic and international services; postcards and postal stationery are sold according to their selling price;
  2. where appropriate, commemorative postcards may be affixed with stamps with denominations other than specified in item 1, provided that their theme corresponds to the commemorative cancellation.

§ 9

The terms for the fulfilment of the orders have been posted on the website of the Online Store of Poczta Polska S.A. in the “Shipping and payment”. 


§ 10

Within 5 business days of the receipt of the payment, the seller will send the philatelic items to the address indicated by the subscriber.
