Terms and Conditions of the Newsletter service of the Online Store of Poczta Polska S.A. 



§ 1
The terms used in the Terms and Conditions of the Newsletter service of the Online Store of Poczta Polska S.A. will have the following meaning:
1. Store – website operating at sklep.poczta-polska.pl via which the Seller presents offers for goods and services and enters into contracts,
2. Consumer – the person referred to in Article 221 of the Polish Civil Code, i.e., a natural person performing a legal action with the trader that is not directly connected with his or her business or professional activity; 
3. Newsletter – a service provided by electronic means by Poczta Polska Spółka Akcyjna with its registered office in Warsaw, ul. Rodziny Hiszpańskich 8, 00-940 Warszawa, consisting in the distribution of commercial information concerning the operations of the Store,
4. Terms and Conditions – Terms and Conditions of the Newsletter service of the Online Store of Poczta Polska S.A.,
5. Seller – Poczta Polska Spółka Akcyjna with its registered office in Warsaw, ul. Rodziny Hiszpańskich 8, 00-940 Warszawa, Poland, entered in the Register of Entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under KRS (National Court Register Number): 0000334972, NIP (Tax Identification Number): 525-000-73-13, share capital: PLN 964,140,000 – fully paid up, http://bip.poczta-polska.pl,
6. Customer – a natural person, legal person or unincorporated entity having legal capacity granted by specific regulations who has entered or intends to enter into a contract via the Store.


§ 2
1. The newsletter is a service provided by electronic means by Poczta Polska Spółka Akcyjna with its registered office in Warsaw, ul. Rodziny Hiszpańskich 8, 00-940 Warszawa, entered in the Register of Entrepreneurs of the National Court Register for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under number KRS: 0000334972, share capital: 774,140,000, fully paid up, REGON: 010684960, NIP: 525-000-73-13 (hereinafter referred to as the “Seller”) via the Store (sklep.poczta-polska.pl). The Newsletter consists in the distribution of information by email about the Seller’s activity to Customers who have consented to this.
2. Under the Newsletter service, the Customers who have agreed to receive the Newsletter will receive commercial information concerning the following: 

  1. description of the current sales offer, 
  2. information about special offers,
  3. information about new products.
3. The Seller represents and warrants that no unlawful content will be delivered under the Newsletter service.
4. The service is provided free of charge. The individual Newsletter emails (Copies of the Newsletter) are sent when it becomes necessary to provide information to the Customer.
5. To correctly use the Newsletter, the Customer will need the following: 

  1. ICT equipment with Internet access,
  2. active email account;
  3. correctly configured web browser in the latest version.
6. The Customer enters into the Newsletter Contract at the Seller’s Store by checking the option “I agree for Poczta Polska S.A. to process my personal data to send me commercial information concerning the products and services of Poczta Polska S.A. by sending a Newsletter of the Store to the email address I have provided. I also certify that I have read the Terms and Conditions of the Newsletter service of the Store of Poczta Polska S.A., and I accept their contents”. After entering into the Newsletter Contract, the Customer receives a confirmation of entering into the Contract by email.
7. The commencement of service provision may take place immediately after entering into the Newsletter Contract. To enter into the Contract, the Customer will have to submit a declaration (by checking the respective option on the website of the Store).
8. The Service is provided for an indefinite period. The Customer may terminate the Contract at any time with immediate effect using the “Opt-out” function in the Newsletter. The consent may also be withdrawn if the customer logs into the customer account and uses the relevant function in the “Notifications” section to opt out of the Newsletter service.

§ 3
1. Complaints concerning the Newsletter service may be submitted: 

  1. by email to sklep@poczta-polska.pl,
  2. by phone to 43 84 20 601.
2. The complaint should include, in particular, a description of the relevant circumstances, the email address specified at the time of registration for the Newsletter service and the email address or mail address for correspondence to which the reply to the complaint should be sent.
3. The resolution of the complaint and communication of the relevant decision will be made promptly, but in any case not later than 5 days after the receipt of the complaint by the Seller. The result of the complaint procedure will be communicated to the Customer according to the information included in the complaint form.

§ 4
1. The Controller of the personal data of the Customers will be Poczta Polska S.A. with its registered office at ul. Rodziny Hiszpańskich 8, 00-940 Warszawa.

3. The personal data as referred to in paragraph 1 are processed pursuant to Articles 6(1)(b) and (c) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – hereinafter referred to as: “GDPR” – to perform the services referred to in the Terms and Conditions, conduct complaint procedures and fill out the obligations arising from the tax law and accounting law as well as – if the Customer consents by checking the relevant option at the Online Store based on Article 6(1)(a) of the GDPR – the personal data may be processed for the following purposes:
4. Providing personal data is optional, but the refusal to provide the data will prevent the provision of the services.
5. Data subjects have the right to access the contents of their data, rectify or erase them or request that their processing be restricted as well as the right to object to their processing, the right to data portability and the right to withdraw their consent at any time without affecting the lawfulness of processing done based on the consent before it was withdrawn.
6. The consent can be withdrawn by submitting a suitable request by email to sklep@poczta-polska.pl. The information must include the personal data identical to the data specified at the time the consent was given, i.e., the first name and last name, email address.
7. The Customer has the right to complain to the supervisory authority. Information about this authority has been provided on the website of Poczta Polska S.A.: www.poczta-polska.pl.
8. The personal data of the Customer may be transferred to a third country in connection with the provision of the service by a processor (cloud solutions) pursuant to standard data protection clauses adopted by the European Commission. The data subject may obtain a copy of the data from the data controller.
9. The data will be kept to send the Newsletter until the consent is withdrawn if the Customer has placed a complaint until the time it is resolved according to the Terms and Conditions.

§ 5
The Terms and Conditions of the Newsletter service of the Store of Poczta Polska S.A. is available on the website of the Store in the “Newsletter” section.
